E&C Democrats Investigate Elon Musk’s Grok for Spreading Rampant Non-Consensual, Sexualized Content

The Millions of AI-Generated Images on X Likely Qualify as Non-Consensual Intimate Imagery and Child Sexual Abuse Material, Congressional Leaders Warn

Energy and Commerce Committee Ranking Member Frank Pallone, Jr. (D-NJ), Commerce, Manufacturing, and Trade Subcommittee Ranking Member Jan Schakowsky (D-IL), and Oversight and Investigations Subcommittee Ranking Member Yvette D. Clarke (D-NY) wrote to xAI CEO Elon Musk today demanding answers about his tech company’s role in creating and promoting abusive, exploitative, and sexually harassing content via generative artificial intelligence (AI). Since the company’s Edit Image feature was launched in December 2025, it has been widely weaponized as a "nudification tool" to digitally alter and post nonconsensual sexualized images of people at an alarming rate. 

"We are deeply concerned about xAI’s refusal to put a stop to the creation of nonconsensual sexualized images, particularly of children," Pallone, Schakowsky, and Clarke wrote to Musk

The Committee leaders wrote that many images created using the Edit Image feature appear to qualify as the publication of non-consensual intimate imagery (NCII) and Child Sexual Abuse Material (CSAM). Last month, a researcher reported that Grok "produced 7,751 sexualized images in one hour." Researchers also found that between December 29, 2025, and January 8, 2026, Grok generated an estimated 23,000 sexualized images of children and at least 1.8 million posts of sexualized images of women. 

"The creation and distribution of CSAM and NCII on your platform using Grok’s Edit Image feature is reprehensible and threatens the safety and well-being of women, men, and children everywhere," the Democratic Committee leaders continued in their letter to Musk. "We are requesting answers to a series of questions that will help us understand how these images have been allowed to be created and what actions have been taken to investigate, implement, and enforce safety guardrails to protect women, men, and children on your platform."

Pallone, Schakowsky, and Clarke also voiced concern that Musk ignored prior warnings about the dangers of Grok’s image generation capabilities. 

"In August 2025, the Consumer Federation of America and many other non-profit groups requested federal investigations into Grok Imagine, an AI image generating stand-alone app and a precursor to the Edit Image feature, 'urging [Grok] to act to stem a dangerous and violative product.' But even after these concerns were raised, you still chose to release the Edit Image feature. It was clearly foreseeable that the Edit Image feature would also be used to create and publish nonconsensual explicit images of women, men, and children just as Grok Imagine had been," Pallone, Schakowsky, and Clarke continued in their letter.

The three Committee leaders also noted the proliferation of Grok-created imagery violated Musk’s own social media platforms rules and content guidelines regarding child safety, abuse/harassment, and adult content. 

As part of their investigation, the Democratic Committee leaders demanded Musk answer a series of questions by March 5, 2026, including:

  • When he became aware of users successfully prompting Grok to generate explicit or nonconsensual images of women or children;
  • The policy differences governing what is and is not prohibited between the Grok Imagine app and the Edit Image feature on X;
  • What, and if any, safety guardrails were implemented at the time of introduction of the Edit Image feature;
  • The total number of images created by the Edit Image feature and the total number that have been removed for violating X’s safety policies;
  • Whether any images have been removed in response to requests from law enforcement or the National Center for Missing & Exploited Children (NCMEC); and
  • A copy of any response by X to the Consumer Federation of America’s request for an investigation or the European Commission in connection with its request for information.
